At StaffrWorks, Inc. ("StaffrWorks," "we," "us"), we respect your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our SaaS platform (the "Service").

1.2 Geolocation Data

Important: Our mobile application and web kiosk may collect precise geolocation data to verify employee attendance ("Geofencing"). This data is collected only when you clock in, clock out, or perform other time-tracking actions. We do not track your location continuously in the background when you are not using the app for work purposes.

1.3 Biometric Data

If your employer enables "Photo Verification" or "Face ID" features, we may collect biometric identifiers or biometric information (such as face geometry or a photograph of your face). Please refer to our Biometric Information Policy for specific details on how this sensitive data is handled.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our Service.
  • Process transactions and send related information (invoices, receipts).
  • Verify identity and prevent fraud.
  • Send technical notices, updates, security alerts, and support messages.
  • Comply with legal obligations.

3. Sharing of Information

We do not sell your personal data. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We may share other information with:

  • Service Providers: Third-party vendors who provide services on our behalf (e.g., Supabase for database hosting, Stripe for payments, AWS for storage).
  • Compliance with Laws: We may disclose information where required by law or subpoena.
  • Business Transfers: In connection with a merger, sale of assets, or acquisition.

4. Data Security

We implement appropriate technical and organizational measures to protect specific data (such as encryption at rest and in transit). However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%.

  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
  • Right to Appeal: If we decline to take action on your privacy request, you may have the right to appeal our decision.

5.1 Notice to California Residents

Under the California Consumer Privacy Act (CCPA) as amended by the CPRA, California residents have the rights listed above. Additionally, under California's "Shine the Light" law, California residents may request certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes.

6. Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personal identifiable information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us.

We may update this Privacy Policy from time to time. The simplified "Last Updated" date at the top of this policy indicates when the latest changes were made.
